Defamation is that which would be deemed to “lower you in the minds of right thinking members of society”. It falls into two main categories-Libel  and Slander.

Libel is a defamatory statement which is in writing. It is “actionable per se” in the courts, so if you can prove that the statement has is defamatory, you do not need to prove that you have suffered a loss as a result.

Slander is a defamatory statement made orally. It is necessarily not “actionable per se”, but there are certain categories of defamatory statements which do fall within that category.

Defamation litigation is both complex and difficult. It will oftentimes become a highly personal exercise and it is an area of the law which requires carefully considered & thoughtful advise. There may well be alternatives to a court action which would remedy the damage without enduring the inevitable stress and upset.
