On the 18th December 2014, an eight year old boy with cerebral palsy was awarded damages of €13.5 million, in addition to a previous interim settlement of €1.4 million.
Our client, now 8 years old, suffered catastrophic injuries at the time of his birth due to negligence at the Erinville Hospital Cork. He suffers from cerebral palsy and frequent seizures, cannot walk, speak or feed himself and requires 24/7 care. The Medical Negligence team had initially brought the case before the High Court in October 2012, at which point liability was admitted and an interim settlement was paid.
On the 21st October 2014, the Medical Negligence team returned to the High Court seeking damages to care for this beautiful boy for the rest of his life and to provide him with all aids and appliances and assistive technology to enable him to reach his full potential.
Our team also put forward an argument that the real rate of return (the amount a lump sum award of damages is presumed to earn over a Plaintiff’s lifetime) should be reduced from 3%. This argument was successful and in this landmark judgement the real rate of return was reduced to 1% in cases such as this one.
After 20 days of hearing before the High Court, judgement was given on the 18th December 2014 in the sum of €13.5 million.
