The Litigation team of Cantillons Solicitors represented a firm of Solicitors who were sued for alleged negligence. The team vigorously contested the allegation of negligence that was made against their clients (the firm of Solicitors).
The Plaintiff, who was making the allegations, was resident outside of the European Union. An Order directing the Plaintiff to provide security for costs was sought from the High Court by the team on the basis that the Solicitors’ firm had a good and bona fide defence to the Plaintiff’s claim.
The application of the team for security for costs was successful and on the 11th February 2013, the Plaintiff was told that unless he lodges €45,000 as a contribution towards the anticipated costs of the proceedings before the 25th April 2013, he could not proceed with his case against the Solicitors.
Following the expiration of this deadline, as the money was not lodged in Court the case was dismissed with costs of the defence of the claim awarded to the Solicitors firm.
