Cantillons Solicitors were instructed on behalf of the family a man who died due to a delay in diagnosing lung cancer.
The circumstances surrounding this case are that the deceased was suffering with chest symptoms and was sent for a chest x-ray, which he duly attended for at Cork University Hospital. This chest x-ray was read by the Radiologist, who advised in his report that further investigations were required, more specifically a CT of his thorax. This report was forwarded to his treating Consultant who sadly never acted upon the advice of the Radiologist. The deceased was not notified that he needed a CT thorax, nor was one arranged by the treating Consultant. As a result of this, the deceased did not undergo any follow up investigations.
Over the course of the next year, the deceased’s symptoms worsened and he was re-referred by his GP to Cork University Hospital for investigations. It was only then that it was discovered that the opportunity had been missed. By the stage it was discovered, it was too late. The deceased had developed stage 4 lung cancer and died shortly thereafter.
Cantillons Solicitors negotiated a significant settlement for the family of the deceased, and indeed separately for the adult children of the deceased who incurred psychological injuries as a result of the negligent care afforded to their father.
