In November 2013, the Medical Negligence team at Cantillons Solicitors successfully negotiated a significant settlement for the widow of a man who had died following a brain haemorrhage. It appeared to his widow that the brain haemorrhage was inappropriately managed at CUH, and that that led to his ultimate demise at a Nursing Home, some short time later in County Cork.
The circumstances giving rise to this case concerned a fifty nine year old man who presented at the Accident & Emergency Department of a busy hospital with symptoms of a stroke. Unfortunately, he did not receive appropriate treatment and as a consequence suffered significant further stroke which resulted in permanent disability and ultimately his death.
The matter was investigated by the Medical Negligence team, and a fatal action was brought against the HSE. Secondly, a claim was brought for the distress sustained by the widow arising out of the tragic events that she had witnessed whilst her husband was ill.
It was a difficult case which required the commissioning of reports from a variety of experts including Neurologists, Neuroradiologists, Vocational Assessors, Actuaries and so on.
The case was about to commence hearing in the High Court in Dublin for three weeks when the settlement was reached which will provide for the widow into the future.
