Brigid ODonnell and the litigation team secure compensation for client who was not made aware of the implications of a replacement life insurance policy

Brigid O’Donnell and the litigation team recently represented a client who suffered significant losses following the purchase of a replacement life insurance plan. The Bancassurance Agent who sold the policy to our client and their spouse failed to adequately explain the implications of the replacement cover. As a result, it was only when our client’s spouse was diagnosed with a terminal illness that the couple realised that the replacement cover, which allowed for a saving of approximately €7 per week, and which the couple had believed was a mandatory requirement for their mortgage negotiations, meant that the total value of their policy was reduced by more than €80,000.00. The claim was fully defended by the Defendants involved. However, when discovery documentation became available, the paperwork demonstrated significant weaknesses in the Defence filed by one of the Defendants. Brigid was pleased to negotiate a substantial settlement on behalf of our client without the requirement to go to Court.
