The team successfully brought a claim for a Garda who was viciously assaulted during the course of his duties in the public office of a Garda Station. The Garda had suffered from a pre-existing condition known as ankylosing spondylitis. We argued on behalf of the Garda that the assault aggravated this pre-existing condition. The Garda was subsequently retired on the basis of advice received from the Chief Medical Officer. The State sought to argue that the proximate cause of the retirement was the pre-existing ankylosing spondylitis and not the assault. We sought to argue otherwise and indeed, did succeed in getting the Court to accept that there was a relationship between the retirement and the assault. This resulted in a very significant award in excess of half a million euros being awarded to the Garda. This was a most satisfactory outcome in a case that was hard fought over a number of days.
